That said, MPT items serve as useful proxies for testing related skills, including specifically the ability to deal with facts and to solve problems within the limits of the law and the range of client goals and needs.

NCBE staff members also arrange a pretest of the item, with 8–10 newly licensed lawyers selected by bar administrators taking the MPT item under exam-like conditions and providing feedback about the item.
